Q: What should I do if my spouse refuses to agree to a separation?

A: You do not need your spouse’s permission to separate. In Ontario, spouses may be separated once one or both spouses decide the relationship is over and they begin living separate and apart.

In some cases, spouses can be legally separated while still living under the same roof, depending on their conduct and circumstances. A family lawyer can help document the separation date and address parenting, support, and property issues.

Q: Do I need to wait one year to get a divorce in Ontario?

A: In most cases, yes. Under Canada’s Divorce Act, the most common basis for divorce is living separate and apart for at least one year.

You may start the divorce application before the one-year period has passed, but the divorce usually cannot be granted until the full separation period has been completed.

Q: Can the one-year separation requirement be waived?

A: Generally, no. In a divorce based on separation, the one-year period cannot simply be waived.

However, a divorce may be granted without waiting one year if the breakdown of the marriage is proven on the basis of adultery or physical or mental cruelty. These grounds require evidence and are less commonly used than the one-year separation ground.

Q: How is child custody decided in Ontario courts?

Courts may consider factors such as stability, caregiving history, emotional ties, the child’s needs, each parent’s ability to provide a safe environment, family violence or safety concerns, and the child’s views and preferences where appropriate, depending on the child’s age and maturity.

Q: When am I legally allowed to remarry after a divorce?

A: You can remarry only after your divorce is final. In most cases, a divorce order becomes effective 31 days after it is granted.

Once the divorce is final, you can obtain a divorce certificate, which is the document generally required to prove that you are legally divorced and able to remarry.
